Application Terms and Conditions
Before entering the “KIBO Relay Around the Earth KIBO” (“this project” below) hosted by bascule Inc. (“this company” below), please carefully read, confirm, and agree to the following terms and conditions (“these terms” below).
Project Overview
Applicants are asked to upload their video messages of “hope” (“video submissions” below) during the entry period using the online application form set up at our specially created site.
A select number of video submissions will be edited or used to create a new video (“edited video” below) and aired on a program (“this program” below) created by the program studio “The Space Frontier Studio KIBO,” which is part of Japanese Experiment Module “KIBO,” at International Space Station. This program is planned to be broadcast (and rebroadcast) on television (including over-the-air broadcasts, satellite broadcasts, cable broadcasts, etc.) as well as on online video streaming services and through website streaming (including archived streaming). Further, for advertising and publicity purposes, this program may be re-edited and rebroadcast via every aforementioned medium (including television broadcasts, online video streaming, and website streaming).
Application Period
From 10:00 on Thursday, July 2nd, 2020 to 24:00 on Wednesday, July 15th, 2020.
Planned Broadcast Schedule
Live broadcast and streaming: Scheduled for launch in summer 2020 (announced on Monday, July 6th, 2020)
(Rebroadcasts and archived streams are planned separately)
Application Guidelines
Entries are only accepted through our online application form, which is available at our specially created site.
Please access the site from your computer, smartphone, or tablet, enter all necessary fields in the application form, and upload your video submission.
*Video submissions are not accepted via mail or E-mail attachments.
*The special site is not compatible with feature phones.
Important to Note When Applying
Please bear in mind the following points when applying to participate in this project.
- Anyone is eligible to apply, regardless of age, sex, or occupation.
- Video submissions must be filmed by the applicant.
- Please film your video submission according to the guidelines listed on the application form. Video submissions that do not adhere to these guidelines will be deemed ineligible for selection.
- When filming, please make certain your video submission does not contain any personal information, including names, addresses, etc.
- If submitting a video that shows a third party, first carefully explain these terms and be sure to obtain proper consent directly from the subject. Submitted videos are assumed to have received consent from all parties involved.
- If the applicant or any subject shown in the video submission is a minor, first carefully explain these terms and receive proper consent from all applicable legal guardians. Submitted videos are assumed to have obtained guardians' consent.
- Video submissions are not accepted if any of the following apply.
- If there is any violation of a third party's copyrights, intellectual property, rights to likeness, rights to privacy, publicity rights, or defamation, or otherwise contains expressions or material that may be interpreted as violating such rights
- If the video submission was created for profit, or as promotional material for commercial, religious, or political activities
- If the video submission contains any material that may disrupt public order, including obscene or violent acts, anything that may have a negative influence on youth, or any depictions of unlawful actions
- If the video submission contains any material that may encourage discrimination
- If the video submission contains antisocial expressions or contents that go against the common good
- While a single applicant may enter an unlimited number of times, videos that have already been entered will be deemed ineligible for selection.
- Applicants retain the rights to video submissions. However, by entering a video submission, applicants agree to grant this company, as well as third parties that this company approves of (collectively referred to as “this company and its affiliates” below) indefinite rights to use video submissions free of charge and without any restrictions placed on the number of times they may be used or the period, region, or manner they may be used in. Among these rights of use are the rights set forth in articles 27 and 28 of the copyright law of Japan, and include rights to reproduction, musical and stage performances, screenings, public broadcasts, oral dictations, exhibitions, distribution, transfer, lending, translations, adaptations, and alterations to the extent this company determines necessary for business purposes. Further, by entering video submissions, applicants agree not exercise moral rights against this company and/or its affiliates.
- Any entry deemed by this company as inappropriate or as not adhering to these terms will be ineligible for selection.
- Please understand that we will not respond to any inquiries concerning selection criteria or reasons for entry selection or rejection.
Entry Withdrawal
To withdraw a video you have entered, please contact our office by 5:00 p.m. on Wednesday, July 15th, 2020.
Please be aware that we will be unable to accept withdrawal requests made after 5:00 p.m. on Wednesday, July 15th, 2020, due to editing and broadcast preparations.
General Prohibitions
This project prohibits applicants from the following.
- Any actions which violate the law or general standards of public decency
- Any actions or behavior connected to crime
- Any actions violating the copyrights, trademarks, or other intellectual property rights included in this project
- Disrupting or interfering with the functions of servers or networks belonging to this company, other applicants, or other third parties
- The commercial use of any information acquired through this project
- Any actions that may interfere with this project's operations
- Unauthorized access or attempted accessing of any relative information
- Collecting and/or storing personal information of other applicants
- Making an entry to this project with dishonest, unfair, or illegal intent
- Any actions which may cause disadvantage, damage, or discomfort to this project's other applicants or other third parties
- Impersonating other applicants
- Using this project as a platform for publicity, advertising, promotion, solicitation, or business activities without the consent of this company
- Using this project as a means to meet members of the opposite sex
- Any action connected to this project which will directly or indirectly benefit antisocial forces such as gangs, criminal organizations, etc.
- Any other actions which this company determines to be inappropriate
Disclaimers
- The contents of this project as well as this program's scheduled air date are subject to change without prior warning.
- This project may be temporarily delayed or canceled without prior warning under any of the following circumstances.
- If carrying through with the project becomes infeasible due to operational or technological constraints.
- If project operations are hindered due to unforeseeable calamities, including natural disasters like earthquakes, as well as fires, power outages, etc.
- Any other situation in which this company determines the project must be cancelled.
- With the exception of cases in which there is intentional and gross negligence on the part of this company, this company assumes no responsibility for any damages or loses sustained by the applicant due to entering, or not being able to enter, this project, as well as any and all damages sustained due to this project's suspension, cancellation, or change of contents.
- If the applicant causes damages to a third party by entering this project, the responsibility and obligation to rectify those damages fall on the applicant alone. Further, if during this project this company and its affiliates become entangled in a dispute with a third party over the use of a selected video, then the applicant may be asked to cooperate in settling the matter, and in such a case the applicant should comply with this request.
- Applicants will not be contacted or notified with regards to the use of submitted videos for this project.
- We cannot respond to inquiries concerning technical aspects of applicants' devices (including smartphones, computers, and tablets).
- These terms may be revised at this company's discretion at any time and without prior warning, and all changes will go into effect from the time said changes are posted.

Applicable Laws and Court Jurisdiction
All applicable laws related to these terms and items therein are based on the laws of Japan. By accepting these terms, you agree to the exclusive jurisdiction of the Tokyo District Court as the court of first instance if there are any disputes arising from or connected to these terms.
